The Tennessee Information Protection Act (TIPA), enacted on May 11, 2023, is a comprehensive data privacy law designed to safeguard the personal information of Tennessee residents. Effective from July 1, 2025, TIPA grants consumers specific rights concerning their personal data and imposes obligations on businesses that handle such information.
Consumer Rights Under TIPA:

Right to Access: Consumers can confirm whether a business is processing their personal information and access that data.

Right to Correction: Consumers can request corrections to inaccuracies in their personal information.

Right to Deletion: Consumers can request the deletion of personal information they have provided or that has been obtained about them.

Right to Data Portability: Consumers can obtain a copy of their personal information in a portable and readily usable format.

Right to Opt-Out: Consumers can opt out of the processing of their personal information for purposes such as targeted advertising, the sale of personal information, or profiling that produces legal or similarly significant effects.
Obligations for Businesses:
TIPA applies to entities conducting business in Tennessee or targeting Tennessee residents, with annual revenues exceeding $25 million, and that either:

Control or process personal information of at least 175,000 consumers; or

Control or process personal information of at least 25,000 consumers and derive more than 50% of gross revenue from the sale of personal information.
Such businesses are required to:

Data Minimization: Collect only data that is adequate, relevant, and reasonably necessary for the disclosed purposes.

Purpose Limitation: Process personal information solely for purposes compatible with those disclosed to the consumer, unless additional consent is obtained.

Data Security: Implement reasonable administrative, technical, and physical data security practices.

Non-Discrimination: Refrain from processing personal information in violation of state or federal laws prohibiting unlawful discrimination against consumers and from discriminating against consumers who exercise their rights under TIPA.

Consent for Sensitive Data: Obtain consumer consent before processing sensitive data, which includes information revealing racial or ethnic origin, religious beliefs, health diagnoses, sexual orientation, citizenship or immigration status, genetic or biometric data, data collected from children under 13, and precise geolocation data.

Transparency: Provide clear and meaningful privacy notices detailing the categories of personal information processed, purposes for processing, how consumers can exercise their rights, and categories of personal information sold to third parties, if any.
Enforcement:
The Tennessee Attorney General is responsible for enforcing TIPA. Businesses found in violation are granted a 60-day period to cure the violation upon notice. If the violation is not remedied within this period, the Attorney General may impose civil penalties of up to $7,500 per violation. Notably, TIPA does not provide a private right of action for consumers.
For businesses operating in Tennessee or targeting its residents, it's crucial to assess data practices and implement necessary measures to comply with TIPA before its effective date.
